These Terms and Conditions ("Terms") govern all purchases made at Apricot Shop, located in Sunnyvale, California, USA ("Shop," "we," "us," or "our"). By purchasing products at our physical retail location (the Barn), customers agree to these Terms.

Apricot Shop operates exclusively as a physical retail business. We do not offer online sales or remote purchasing services.

We sell the following products:

• Fresh apricots

• Chocolate products

• Apricot jam and preserves

• Gift boxes and related packaged goods

All products are sold subject to availability.

Because many of our products are fresh and perishable, availability and quality may vary depending on season and supply conditions.

All prices:

• Are listed in U.S. Dollars (USD)

• Are subject to applicable California sales tax

• May change without prior notice

The price charged will be the price displayed at the time of purchase. (An additional 3% fee applies to credit card payments.)

We reserve the right to refuse personal checks at our discretion.

Returned checks may be subject to additional fees as permitted under California law.

5. No Returns / No Refund Policy

All sales are final.

Due to the perishable nature of our products (including fresh fruit and food items), we do not accept returns, exchanges, or offer refunds.

Customers are encouraged to inspect products before completing their purchase.

This policy does not limit any rights required under applicable California consumer protection laws.

Customers are responsible for reviewing product ingredients and asking staff about potential allergens.

Apricot Shop is not liable for allergic reactions or adverse effects resulting from consumption of our products, except where required by law.

Apricot Store shall not be liable for any indirect, incidental, or consequential damages arising from the purchase or consumption of our products.

Our total liability shall not exceed the amount paid for the purchased product.

Nothing in these Terms excludes liability where such exclusion is prohibited under California or federal law.

These Terms shall be governed by and interpreted in accordance with the laws of the State of California, without regard to conflict of law principles.

Any disputes shall be subject to the jurisdiction of the courts located in Santa Clara County, California.
